RESOLUTIONS ADOPTED IN FEDERAL EXECUTIVE OF NFPE HELD AT LUCKNOW ON 26 & 27 JULY, 2011

THIS FEDERAL EXECUTIVE MEETING OF NFPE HELD AT LUCKNOW FROM 26-07.2011 TO 27.07.2011 AFTER DETAILED DELIBERATIONS ON ALL ISSUES RELATED TO THE PROPOSED INDEFINITE STRIKE FROM 2011 JULY 5TH HAS RESOLVED THE FOLLOWING:

1. This Federal Executive has come to the unanimous conclusion that, under the given circumstances the settlement reached with the Administration on the 25 points Charter of Demands is the best possible and fully ratify the decision of the JCA to defer the strike.

2. This Federal Executive further direct the NFPE & JCA leadership to take follow up action to get orders released on all the agreed items in a time bound manner.

3. This Federal Executive demand the Secretary, Department of Posts, to arrange another review meeting on the PLI related issues as the decentralization of certain important PLI/RPLI functions to Divisions has been done contrary to the sprit of the discussions held on 01.07.2011. Review meetings may also be arranged with the unions of Civil Wing and Postal Accounts as assured during the final round of discussion.

4. Regarding the formation of the Committee to review the Speed Post hubs and first class hubs (L 1,L 2) the Federal Executive is of the unanimous view that the induction of new technology and consequent changes in the mail processing should not lead to indiscriminate closure/merger of existing RMS Offices and interest of employees should be protected. The delay in public mail should be avoided and speedy delivery of articles should be ensured.

5. The Federal Executive further resolve that if any unilateral violation of the assurances given to the Staff Side take place then NFPE and JCA shall organize agitational programmes.

THE MEETING WAS ATTENDED BY ALL THE NFPE EXECUTIVE MEMBERS AND GENERAL SECRETARIES OF ITS AFFILIATES. THE MEETING COMMENCED AT 11.00 HRS ON 26-7-2011 WITH THE HOISTING OF NATIONAL AND FEDERATION FLAG. ALL THE FEDERAL EXECUTIVE MEMBERS WERE WELL HONORED BY THE RECEPTION COMMITTEE OF THE NFPE UP CIRCLE.

THE FEDERAL EXECUTIVE REVIEWED THE ACTIVITIES OF ALL THE AFFILIATED UNIONS/ASSOCIATION WITH REGARD TO THE STRIKE OF 5TH JULY,2011 SETTLEMENT. ALL THE EXECUTIVE MEMBERS AND GENERAL SECRETARIES LAUDED THE ROLE OF OUR EMINENT SECRETARY GENERAL SRI. M. KRISHNAN IN EFFECTIVE DEALING WITH THE SITUATION AND DURING THE NEGOTIATIONS WITH THE POSTAL BOARD.

Amendment of Service Rules – 6th Pay Commissions recommendations

Subject:- Sixth Central Pay Commissions recommendations – amendment of Service Rules – regarding

This Department in OM No.AB14017/61/2008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMs dated 15.12.09 (Non-Technical) and 18.01.2011 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6th cpc recommendations have been issued in OM dated 24.4.09

2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the Ministries/Departments/Cadre Controlling Authorities of Organized Group ‘A’ Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPT/UPSC & Ministry of Law.

JOINT CONVENTION OF UNIONS ON PFRDA BILL

A Joint convention of unions consisting Confederation of Central Government Employees and Workers, All India State Government Employees Federation, All India Defence Employees Federation, BSNL Employees Union, School Teachers Federation of India, All India Federation of University and College Teachers Organizations and Organizations of Railways Workers was held at MPCU Shah Auditorium, Shri Delhi Gujarati Samaj., Raj Niwas Marg, Civil Lines, New Delhi on 22.07.2011. The convention was presided over by a joint presidium of Coms. S.K. Vyas(Confederation)R.G. Karnik (AISGEF), P.R.Memon (Railways), V.A.N. Namboodri (BSNL) Ashok Kumar Burman(AIFUCTO) and Sardar Singh (Defence). In the beginning Com. Sukomal Sen (AISGEF) put written detailed draft declaration to be adopted at National Convention and elaborately discussed all the issues which will adversely affect the interests of workers and employees after enactment of the PFRDA Bill by the parliament. If once authority is formed it will also interfere in the existing pension scheme.com. Basudev Acharya M.P., CPI(M) Parliamentary Party leader in Lok Sabha elaborated discussed about PFRDA Bill and told as to how the Left MPs resisted and prevented the move of UPA-I Government who wanted to introduce this Bill.But after withdrawal of support from the Government on nuclear bill issue , the Government accelerated the speed of neoliberal economic policies. After coming back in power the congress lead UPA-2 Government has introduced the PFRDA Bill again in Lok Sabha with the help of main opposition party B.J.P. When a Vote of division was demanded by us. Com. Tapan Sen General Secretary CITU stated the new pension scheme is totally Fraud as the assurance given by the Government will never be fulfilled.

Other main speakers on the subject were Coms. Ashok Kumar Burman S/G, AIFUCTO, Shiv Gopal Mishra S/G AIRF, Muthusundram G/S AISGEF, D. Biswas (BEA), Shyam Sunder (Pensioners Federation), Sardar Singh (AIDEF), P.Abhimanyu(BSNL), Elangobin (DREU), Rajenderan (School Teachers Association),Com. M.K.Pandhe , Senior Veteran Leader CITU also expressed his views on PFRDA Bill and appealed to all to launch extensive campaign to mobilize and unite the entire working class to oppose and defeat the bill.

`Com. M. Krishnan Secretary General NFPE stated that new pension scheme is nothing but gambling by the Government. He cited the examples how the amount of pension of U.S. employees became zero after recession and bankruptey of finance and insurance Companies there. He assured that NFPE will launch all agitational programmes to be decided by the unions and fight tooth and nail the PFRDA Bill.

Policy to be followed in case where persons refuse promotion to a higher grade–Clarification

OFFICE MEMORANDUM

Subject : Policy to be followed in case where persons refuse promotion to a higher grade.

The undersigned is directed to invite the attention of the Ministries/Departments to the provisions contained in this Department's O.M. No.1/3/69-Estt.(D) dt. 22.11.75 on the above subject and to say that this issue was discussed in the meeting of the National Council. It was observed that in many cases persons refuse promotion purely to gain monetary benefit specially in cases where the increment of the officer is due in the lower grade shortly. This it was felt causes considerable hardship to many Govt. employees due to the chain reaction fo postponing of the promotion of officers down the line and awaiting promotion. In order to discourage such refusal of promotion, the Government issued orders laying down that those officers who refuse promotion should not be issued any fresh offer of promotion for a period of six months from the date of such refusal.

2. Govt. have recently taken a decision to further liberalise the formula of fixation of pay, in order to avoid anomalies in the matter of fixation of pay. These orders are being separately issued.

3. In view of the fact that Government have decided to further liberalise the procedure of fixation pay of officers, and also to reduce cases of refusal of promotion to the barest minimum which adversely affects of the promotion prospects of officers working down the line, it has now been decided to modify the provisions contained in this Deptt's O.M. No.1/3/69-Estt.(D) dated 22.11.75 mentioned in para 1 above, to the effect that from the date of issue of this order, refusal of promotion by an officer should entail that no fresh offer of promotion would be issued to him for a period of one year, instead of six months as provided for in the earlier instructions.

4. It is further clarified that in cases where the reasons adduced by the officer for this refusal of promotion are not acceptable to the appointing authority, then he should enforce the promotion on the officer and in case the officer still refuses to be promoted, then even disciplinary action can be taken against him for refusing to obey his orders.

5. These instructions take effect from the date of issue of this letter.

6. In so far as the officers working in the Indian Audit and Accounts Deptt., these orders are being issued with the concurrence of the Comptroller and Auditor General of India.

7. Ministry of Finance etc. are therefore, requested to bring the above decisions to the notice of all officers working under them for their information and compliance.

India Post to lose its monopoly; govt. forces courier cos to charge double rates

NEW DELHI: A planned overhaul of a 113-year-old postal law proposes to end government monopoly completely in the next decade and a half, but, ironically, sets the clock back for courier companies, which are governed by a different policy at present.The draft Post Office Bill 2011 aims to open the letter mail segment to the private sector in 15 years by withdrawing all exclusive rights to India Post and removing all pricing curbs on private courier companies. The Department of Posts has sent the draft bill for cabinet approval to replace the archaic Indian Post Office Act 1898. The amendment will also provide greater legitimacy to the courier industry.
"Considering the role of couriers in the present economy, opening up the letter mail sector to them will not only accord legitimacy to the private operators but also would be recognition of market reality ," said an official in the department privy to the cabinet note. Courier companies are not celebrating , though. They say the transition regime proposed is too harsh and could end up killing the over Rs 7,000-crore domestic industry that engages nearly one million workers and pays Rs 1,200 crore in service tax.
In the run-up to the complete deregulation , the draft bill has proposed to open the express mail segment (EMS) with a "reserve area" of 50 gm for all articles at a price multiple of twice the government EMS rate. That is, a courier firm will have to charge at least Rs 50 for a package weighing up to 50 g, which is twice the Rs 25 charged by India Post for its Speed Post service for a similar package. At present, couriers are allowed in the EMS segment without any restriction or price, making the market fiercely competitive. The reserve area regulation will give India Post time to prepare for a more competitive regime.
"The proposal to have a reserve area for EMS is unfair and will lead to anti-competitive behavior by the postal department," said Vijay Kumar, chief operating officer, Express Industry Council of India . It could lead to the extinction of the courier industry, he said. Introduced in 1986, Speed Post is the only EMS service provided by India Post. The department has strongly defended the proposal to impose a reserve area by citing international examples. Globally, postal deregulation has been in phases and exclusive rights for state-run postal business still exist in many countries. In India, the courier industry has run ahead of the postal laws because it was allowed under the foreign direct investment regime, which allows 100% overseas investment in the business. International courier companies, such as DHL , TNT, FedEx and UPS , secured FIPB approval under the 100% FDI route.
The bill will now recognize them under the postal law, but the proposed transition turns the clock back somewhat by imposing restrictions that did not exist earlier. "Over 60% of the business for small- and medium-sized courier business in India is dependent on document delivery, which is typically within the 50 gm weight segment ," said RK Saboo, deputy managing director, First Fight Couriers. The proposal was retrogade and would force small courier firms to close down, he said.
The private industry is also not enthused by the entry in the normal mail business, or letter mail segment , where the draft bill has fixed a reserve area of Rs 150 gm for all registered couriers at a price multiple of Rs 2 times the postage of letter mail. The industry says India Post service is highly subsidized , which industry says will make it difficult for it to compete. The bill, which is likely to be introduced in the forthcoming monsoon session of Parliament, has also proposed to simplify registration and licensing of couriers without charging any fees. Most large domestic courier companies in the country like DTDC, First Flight and Skypak are all registered with the Registrar of Companies

GOVERNING BOOKING OF ACCOMMODATION IN MINISTRY OF UD

HOLIDAY HOMES AND TOURING OFFICERS’ HOSTELS

Application for booking

1. Incomplete applications : The applications incomplete in any respect, or not accompanied with Demand Draft or not bearing the full amount of lodging charges, will be summarily rejected and returned by ordinary post.

2. Applications not verified by the Administrative Division : Such applications will not be entertained.

3. Retired government servants: Retired Government servants willing to avail the Holiday Home facilities should enclose self attested copy of the PPO. Retired government servants can be provided accommodation in Touring Officers’ Hostels, after meeting the requirement of touring and serving officers, on charges applicable to private persons.

4. Issue of Booking confirmation slips : The applicants should collect the Booking slips from the office of the allotting authority themselves. Otherwise, the Allotting Authority will dispatch the booking slip by ordinary post, at the risk of the applicant. The Allotting authority shall not be responsible for their loss or delay in delivery by the postal authorities. Therefore, applicants are advised to enclose a self addressed, sufficiently stamped envelope to receive the booking slip. Confirmation in respect of online applications will however not be despatched as these can be downloaded online by quoting booking request ID and I.D. Card no.

5. Priority in Booking : Ordinarily, the booking is released on ‘first-come first-served’ basis. However, the Allotting authority has a right to assign priority in booking in following order :

a. Sitting Member of Parliament

b. Central Govt. employees (on official visits)

c. Serving Central Govt. employee (on leave, LTC or personal visits)

d. State/PSU employees (on duty/leave)

e. Others

6. Emergency Quota : The Allotting Authority is authorized to keep any room in reserve to meet urgent requirements of unforeseen nature or to accommodate VIPs and/or Senior Officers. The Allotting Authority is empowered to reduce the period of booking, or to cancel the booking altogether, or change the previously booked room, to meet such emergent requirements.

7. Touring Officers’ Hostels : These hostels are meant primarily to facilitate the visiting officers during their official journeys. Therefore, the priority for booking in Touring officers’ Hostels is given to such officers. However, rooms remaining vacant after fulfilling the requirement of touring officers, can be made available to accommodate the Government employees during their visit to outstations on LTC, leave, etc.

8. AC Rooms : For AC rooms, the AC charges, wherever prescribed, will be charged even if guests choose not to make use of the Air-conditioners.

9. Rooms not occupied after Confirmed booking : After the confirmed booking, if the room/suite remains unoccupied for a period exceeding two days, the booking shall stand cancelled. The Allotting authority is empowered to allow such room/suite to be occupied by other guests.

10. Refunds : There is no provision for refund of reservation charges even if the accommodation is not occupied or partly occupied or vacated early. No correspondence regarding refund of booking charges will be entertained. Demand drafts, erroneously prepared in excess of the payable charges, should be replaced before the release of booking. Such excess payment will not be refunded after depositing of the Demand draft in Government treasury.

11. Booking of Additional room: Only one room/suite will be booked in the name of one Government servant/family. Additional room/suite will be allotted, subject to availability, on payment of rent, applicable to private persons, in exceptional circumstances, at the sole discretion of the Allotting Authority. However, there will be no advanced reservation of additional rooms.

12. Official Tour: The booking on grounds of official visits will be made only on furnishing of a copy of the city-wise tour program or a certificate from the Controlling authority, indicating clearly the duration of the tour program. In the absence of such a certificate, the rates applicable as on personal visit will be charged.

13. Booking in Holiday Homes/Hostels to officers on Transfer : The officers joining on transfer/posting at a new station, will not be treated as on official tour, and will not be treated at par with touring officers. Accordingly, they will not be entitled to avail the lodging facility in Holiday Homes/Hostels at the rates applicable to touring officers, but on rates applicable as on personal visit.

14. Period of booking: Accommodation is provided for a period not exceeding 10 nights (5 nights in season period). In Holiday Homes/Guest Houses like Mussurie, Goa, Udaipur, etc. which have very few units but attract visitors throughout the year, the period of stay has further been restricted to 3 nights maximum. In exceptional cases, accommodation in excess of this limit can be permitted with the prior approval of the Deputy Director, Directorate of Estates, New Delhi, wherever necessary, will obtain orders of the Director of Estates.

15. Advance payment of room rent : The Allotting authority is not obliged to provide accommodation in holiday home/hostel in cases where the applicant has not made advance payment of the room rent, along with the application form.

Online-applications

16. Only online applications shall be entertained for advance reservation for holiday homes where online facility has been commenced. Offline requests for advance reservation in such holiday homes will be summarily rejected.

17. Application will be considered for confirmation only after receipt of hard copy with requisite Demand draft, complete in all respects. Incomplete/unverified applications will not be entertained. Confirmation will be subject to availability.

18. Applications received after 10 days (including holidays) from the date of registration are liable to lose priority, assigned by Booking Request ID. Applications although registered but not received with DD within 20 days from the date of registration will be removed from the list of applicants.

19. Requests for Refunds/postponements after confirmation of booking, shall not be entertained.


Check-in

20. Check-out time : 9 AM ; Check-in time: 11 AM to 12:00 noon. However, to avoid inconvenience to the visitors who reach the destination early in the morning after night journeys, the occupants are advised to vacate the rooms at the earliest on the last day of stay.

21. Right to Admission: The entry to the Holiday Home/Touring Officers’ Hostels will be strictly on production of valid Identity Card issued by the Government and the booking slip issued by the Allotting Authority. Occupation of room without booking slip/authority slip is not permitted.

22. Booking not transferable: Because of security considerations, the entry to the Holiday Home/Hostel will be restricted to the person whose name appears on the booking slip, and his/her dependent family members. The caretaking staff is authorized to disallow provision of accommodation if the applicant is not present physically at the time of checking in, even though he is carrying the confirmation slip. Likewise the entry of the additional persons accompanying the authorized visitor can also be refused

23. Dependent family members: if not accompanying the Government servant, they must carry alongwith confirmation letter, (a) a photocopy of the Government servant’s Identity card, (b) proof of their own identity specifying their relationship with the government servant, and (c) Certificate of Dependence issued by administrative authority of the applicant. Attested copy of the CGHS card containing their photographs can also be accepted for applicants covered under CGHS scheme.

24. Retired Government servants availing the facility of Holiday homes: As the entries in the Check-in/Arrivals Register are to be made by the Retired Government servant in their own writing, the presence of retired government servant is necessary at the time of checking in. A photocopy of the PPO should also be presented at the time of checking in.

25. Number of guests: The occupation of more than 4 persons (2 Adults and 2 children) in the double-bedded rooms is not permitted. The caretaking staff has been directed not to allow entry or provide service to the additional persons over and above the prescribed limit.

26. Visitors without Identity Card: Visitors carrying the booking slip but not carrying valid identity card issued by the Government, at the time of checking in, will be treated as private persons, and will be levied lodging charges as such.

During Stay

27. Facilities : The caretaking staff will provide to the guests the following items only once at the time of occupation of the rooms : toilet soap (small) – one, washed towel – one, washed bed-sheet/bed-cover – one set, washed pillow covers – one set, fresh toilet-paper roll. The guests are advised to make their own arrangement for additional needs as per their requirement.

28. Occupation after booking period : Unless extended by the Allotting Authority in writing, the occupation of the room, after expiry of the booking period, will be unauthorized. Such occupant(s) are liable to face eviction by the caretaking staff without any prior notice, and imposition of damages.

29. Washing charges : The caretaker is authorized to charge washing charges @ Rs.15 per day per room from the occupants and issue receipt. The fund so collected will be kept in the custody of the JE concerned with maintenance of the Holiday Home/Hostel, and will be used for washing the towels, bed-sheets, curtains, quilts periodically.

30. Catering facility: The catering charges wherever available will be settled by the guests with the caterer of the Holiday Home/household staff directly before check-out.

31. Feed-back : Any complaints/suggestions regarding maintenance, house-keeping, catering or misconduct on part of the caretaking staff should be brought to the notice of the Director of Estates, Nirman Bhawan, New Delhi, and/or the Allotting Authority in writing.

32. Cooking is strictly prohibited in the rooms of Holiday Homes/Hostels. 33. Proper decorum : The Guests are advised to maintain decency and decorum throughout the stay period. Causing inconvenience/disturbance to other inmates through noise or rowdy behaviour will be dealt with sternly. Consumption of intoxicants in the premises is strictly prohibited.


34. Pets are not allowed in the Holiday Homes/Touring Hostels.

35. Damage to property : The occupants will be liable to make good any damage/loss to property, fixture, fittings and furniture during the period of their stay in the Holiday Home/Hostel.

36. Visitors of the Guests : No unauthorized person(s) will be allowed to stay with or visit the Guests in the hostel/Holiday Home after 10 pm.

37. Breach of conditions : In case, the accommodation is not vacated on the expiry of the period or for breach of any terms and conditions stated above, the occupants will be summarily evicted physically, with force if necessary, without any notice, under Section 3-A of the Public Premises (Eviction of Unauthorized Occupants) Act of 1971, notwithstanding any other action that may be taken against him/her under the relevant Allotment Rules/Service Rules. They will also liable to pay market rate of licence fee as damages. Common grounds for non-acceptance of applications for booking
